With the coming of spring shall come the trial of Lapeer Circuit Court Judge Byron Konschuh, who is charged with five counts of embezzlement by a public official of more than $50. A jury trial in March or April will decide if the judge stole money from the people who elected him as County prosecutor.

After hearing testimony from nine witnesses in Lapeer County District Court, Shiawasse District Court Judge Terrance Dignan bound Konschuh over for trial on all five counts. The court had heard testimony from a from a detective from the Michigan State Police, Lapeer County Chief Assisrtant Prosecutor Steve Beatty, and the CEO and Managing Director of Resolution Experts, P.C., Jim Schmid, and others in the preliminary hearing.

Testimony included information that 41 checks made out to the Lapeer County prosecutors Office were deposited in personal checking accounts controlled by Konschuh for a period covering four years. The checks totaled $1,802. Lawyers argued over whether the money was technically "public" money.
